Notice to Practitioners - Circuit Hearings


The Court presently conducts circuit trial listing hearings (TLHs) by videolink (Albany, Esperance, Kalgoorlie, South Hedland and Karratha) or telephone conference (Broome, Derby, Kununurra, Carnarvon, Geraldton, Bunbury and Busselton).

Effective 1st January 2017, in an effort to minimise poor audio quality issues experienced during telephone conferences, circuit TLHs will be conducted solely by videolink. A circuit TLH will commence at 9:15 am.

The protocol contained in Annexure A to Circular to Practitioners CRIM 2010/3 - Circuit Hearings is deleted.

Counsel for the prosecution and defence based in Perth are to participate in proceedings in person in the courtroom at Perth. Counsel for the defence based in the country will appear in person in a courtroom at the circuit location.

Generally, accused persons on bail and represented by counsel will answer their bail by reporting at the local courthouse in the circuit location. If the accused person is to answer their bail at a location other than the courthouse at which they were bailed to appear, Counsel will need to comply with the procedures set down in Practice Direction CRIM 1 of 2008 Appearances by Accused at Alternate Venues. Accused persons in custody that are required by Counsel to participate in the TLH will do so by videolink from the prison.
